Affiliate Programme Terms & Conditions
By signing up as an affiliate, you agree to comply with and be bound by the following terms and conditions. Please review them carefully.
1. Eligibility
- The Affiliate Programme is only open to residents of Mainland UK. Any customers located outside of Mainland UK are not eligible to participate.
- To participate, you must be 18 years or older and have an active website, blog, or social media platform that aligns with Photomart's values and products.
- Photomart reserves the right to refuse or terminate any affiliate account deemed inappropriate or unsuitable at its sole discretion.
2. Affiliate Registration and Approval
- To enroll in the Affiliate Programme, you must submit an application via our website. Once submitted, you are required to email sales@photomart.co.uk with links to all your social media accounts and a brief message stating which products you wish to promote and be affiliated with.
- Your application will only be considered complete once this email is received. Affiliates are not formally considered part of the programme until they receive a formal acceptance certificate from Photomart.
3. Commissions
- Affiliates will earn commissions on all qualifying sales generated through their unique affiliate link. The current commission rate is [X]% of the total sale value. Shipping and tax are not included in the sale value used to calculate commissions.
- There is a 14-day vesting period before funds from commissions become available for withdrawal.
- The minimum commission available in order to request a withdrawal is £5.
- Commission is calculated on a case-by-case basis, depending on the specific programme you are a part of. Even if a programme appears as available in your affiliate dashboard, you will not receive commission for it unless you have been explicitly approved by [Company Name] for that programme. To access additional programmes or seek approval, please contact sales@photomart.co.uk.
4. Errors in Commission Rates or Data Input
- Photomart strives to ensure all information related to commission rates and programme details is accurate. However, in the event of any typographical errors, data input errors, or technical faults (e.g., an incorrect commission rate being displayed), Photomart reserves the right to correct such errors without prior notice.
- If a mistake occurs and is later identified, Photomart will adjust the commission rate to the correct value and rectify any transactions that were calculated based on the erroneous rate. Affiliates will not be entitled to retain commissions calculated from incorrect data.
5. Withdrawals
- Commissions are paid monthly, but withdrawals are not automated. Affiliates must request their withdrawals through their online account or by contacting the company directly. A minimum payout threshold of £5 applies before funds can be released.
- It is the affiliate's responsibility to ensure payment details are accurate and up to date. Any fees resulting from incorrect payment information will be deducted from the commission.
6. Affiliate Responsibilities
- Affiliates must use ethical marketing practices and comply with all applicable laws and regulations.
- Affiliates must use the affiliate section of their online account to generate referral links for the products they wish to promote as part of the programme.
- Affiliates are prohibited from bidding on [Company Name] branded keywords or using misleading or deceptive marketing strategies.
- Self-referrals are not allowed, meaning affiliates cannot make purchases through their own affiliate links.
- Photomart reserves the right to request the removal of any affiliate advertising and may require affiliates to use pre-approved marketing media provided by Photomart.
7. Cookies and Customer Attribution
- Cookie expiration for customers recognised as affiliates is set at 1 day. This means customers must use affiliate links again for future purchases to be recognised as affiliate-generated sales. If a customer returns to the website after 1 day without using an affiliate link, no commission will be awarded for that purchase.
8. Limitation of Liability
- Photomart will not be held liable for any errors produced as part of the affiliate programme, whether related to commission calculations, affiliate tracking, or any sort of loss resulting from participation in the programme.
- This includes errors or technical malfunctions in the Affiliate Programme system, incorrect commission rates, or erroneous programme details.
9. Termination
- Photomart reserves the right to terminate any affiliate account at any time, for any reason, including violations of these terms. In the event of termination, any pending or unpaid commissions may be forfeited. If fraudulent or unethical activity is suspected, legal action may be taken.
10. Modifications to the Terms
- We may modify these terms and conditions at any time. Any changes will be communicated on our website. Continued participation in the Programme after any such changes will constitute your acceptance of the new terms.
11. Governing Law
- These terms and conditions are governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
